1. Acceptance of Terms
By accessing or using the website at pointform.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you should not access or use the Site.

When you submit information through our contact form, you acknowledge that:
- Your submission does not create a business relationship, contract, or obligation of any kind on the part of PointForm.
- We may respond to your inquiry at our discretion and are under no obligation to do so.
- You are responsible for the accuracy of the information you provide.
7. Disclaimer of Warranties
THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS PROVIDED ON THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POINTFORM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
PointForm does not warrant that the Site will be available without interruption, that defects will be corrected, or that the Site or its server are free of viruses or other harmful components.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POINTFORM, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE.
IN NO EVENT SHALL POINTFORM'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. Indemnification
You agree to indemnify, defend, and hold harmless PointForm, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Site or violation of these Terms.

The Site may contain links to third-party websites or services that are not owned or controlled by PointForm. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. Inclusion of any link does not imply endorsement by PointForm.

16. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising out of or related to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, and you consent to the personal jurisdiction of such courts.
